MijnDomein.com / Beter Webhosting BV (a division of Baffoon Internet Services Holland BV - "BISH BV") provides web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of MijnDomein.com / Beterwebhosting.nl are subject to the following terms of service:

Indemnification Policy
You agree to use all MijnDomein.com / Beterwebhosting.nl services and facilities at your own risk. MijnDomein.com / Beterwebhosting.nl specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall MijnDomein.com / Beterwebhosting.nl be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold MijnDomein.com / Beterwebhosting.nl harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against MijnDomein.com / Beterwebhosting.nl, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it’s agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless MijnDomein.com / Beterwebhosting.nl against liabilities arising out of: Any injury to person or property caused by any products sold or otherwise distributed in connection with MijnDomein.com / Beterwebhosting.nl’s server(s). MijnDomein.com / Beterwebhosting.nl reserves the right to intervene with any of the sites hosted on its' servers in the interest of its' customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from MijnDomein.com / Beterwebhosting.nl’s server. MijnDomein.com / Beterwebhosting.nl shall be the sole judge of what violates this Policy.

Billing:
We bill annually, depending upon the plan. We accept Visa, Master Card and PayPal, or payments by bank or giro.

Clients are encouraged to pay by credit card as it is the easiest way to handle payment at this time. Their are no contract periods but for each successive period, your contract is automatically renewed unless we are notified otherwise.

Late Payments:
All accounts are billed according to the dates they were first activated on. If you will not pay for service renew in 5 days after deactivation, your account will be suspended. If you will not pay for service renew in 21 days after deactivation, your account will be terminated. You will receive an email reminder 5 days till deactivation.

Renewals
If you do NOT wish to renew your account (or if have not paid us in time) we may delete your account 1 - 8 days before the end of the yearly period due to administrative reasons. All deleted content can NOT be recovered.

Acceptable Use:
All services provided by MijnDomein.com / Beterwebhosting.nl may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless MijnDomein.com / Beterwebhosting.nl and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all MijnDomein.com / Beterwebhosting.nl servers This includes sites that include sexually explicit or hardcore images and/or advertising. We do not have a problem with sites of an adult nature, but we do not allow pornographic sites. If you think your site may violate our Terms Of Service, please ask us before signing up for an account so that we may determine if we can host your site. MijnDomein.com / Beterwebhosting.nl reserves the right to determine what is and what isn't acceptable for our servers. Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company. Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez, Ilegal MP3, and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.

Serverload:
Since your site is hosted on a shared server there are some rules to keep our servers smoothly running. Therefore we cannot allow sites that require too much serverload. If a site gives too much load on the server for any reason, we will be forced to suspend this account to make sure the server keeps going smoothly.

SSH (Shell) access:
We might, in some cases decide to give SSH access to an acount for a limited time. We cannot garantee however that your request will be granted, mostly there are other ways to do what you want to do, like FTP. Before we give access you'll need to fax us a copy of your drivers license or passport and tell us why you need SSH access. Furthermore all sessions will be logged and all possible damage (either intentional or unintentional) done to our servers can (and will) be recoverd from you. If you don't have any experience with SSH we'll recommend you don't use it.

CGI Scripts & Anonymous FTP:
Each account comes with its own cgi-bin. You are free to use any CGI scripts you wish, however we reserve the right to disable any CGI script that effects normal server operation without prior warning. We don't allow Anonymous FTP on our servers.

Banned Scripts:
The following scripts are banned from use on our servers and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc.

Background Running Programs:
Background daemons in general are prohibited, we will consider requests on a one on one basis. If allowed extra charges will be assessed based on resources on system maintenance needed.

IRC:
We currently do not allow IRC or IRC bots to be operated on our servers.

Backup:
MijnDomein.com / Beterwebhosting.nl is not responsible for backups for mySql databases. Subscriber acknowledges that they will backup their own databases from the backup utility provided from their control panel. MijnDomein.com / Beterwebhosting.nl will however do other backup's of websites, images, cgi-bin, mail, etc.

Commercial Advertising - Email:
Our servers may not be the source, intermediary, or destination address involved in the transmission of spam, flames, or mail bombs. Your domain may not be referenced as originator, intermediary, or reply-to address in any of the above. SPAM /illegal content advertising sites on other servers which in turn contain links to a domain on our servers is prohibited. We consider spam any mass unsolicited message in the mediums of Newsgroups and Email. If you are found to have spammed, then we will immediately, without warning, disable your domain. In addition, we will impose a $100 penalty for each spam policy violation. We reserve the right to refuse or cancel service to known spammers. Lastly, we reserve the right to determine what violates this policy. As such, any violation will result in immediate deactivation of services without refund. Server Abuse: Any attempts to undermine or cause harm to a server is strictly prohibited.

LIMITATION OF LIABILITY:
MijnDomein.com / Beterwebhosting.nl shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from MijnDomein.com / Beterwebhosting.nl servers going off-line or being unavailable for any reason whatsoever. Furthermore, MijnDomein.com / Beterwebhosting.nl shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of MijnDomein.com / Beterwebhosting.nl servers. All damages shall be limited to the immediate termination of service. Violations of these Acceptable Uses Policies should be referred to info AT MijnDomein.com / beterwebhosting.nl. All complaints will be investigated promptly. Neither MijnDomein.com / Beter Webhosting or Baffoon Internet services will ever be responsible for errors or downtime caused by circumstances beyond our control. MijnDomein.com / Beter Webhosting BV - Resource Abuse Policy



Any website on our shared servers that uses a high amount of server resources (CPU, memory usage, and network resources) will be given an option to pay for a dedicated server (or VPS). The abuse and misuse of shared system resources is a serious problem. Accounts on a shared server must share resources with other users so we must limit how much of the CPU and memory that can be used by any one account. In all fairness, we cannot allow one or two clients to use all of the system resources on a shared machine and have all other clients suffer because of it. Excessive CPU & memory usage by one or more clients causes extreme slowness in all areas: MySQL, Email, HTTP and more. If the CPU & memory usage by a few clients gets out of hand, all sites hosted on the machine will return errors and not be accessible in any way.

AVERAGE SERVER RESOURCE LIMITS
Memory usage may not exceed 2% per domain/file/application
CPU usage may not exceed 4% per domain/file/application
Apache connections may not exceed 10 connections
5 MySQL maximum user connections allowed
100 emails per hour, per domain

There are special exceptions to these rules to be determined at the time we discover abuse. There are different combinations of usage that can create problems and other special cases. At any given time a server is unstable and an account is found to be the cause, we reserve the right to suspend the account to keep the server online and operating normally. If the usage is an increasing trend, we recommend the user invest in a dedicated server so the website can grow at a normal rate without restriction.

SUSPENSIONS
In the event your website has been suspended for resource abuse (abuse that cannot be resolved by removing/changing a script, etc.) and you do not wish to upgrade to a dedicated server to accommodate your site needs, we will only release the suspension within 48-96 hours. This is to ensure the CPU intensive site slows down in traffic to avoid further damage and problems. A backup will then be provided of your files or you will be allowed FTP/cPanel access for a certain time period (max. 24 hours). Any questions about our abuse policy may be answered by opening a ticket with our abuse division. You may visit the helpdesk 24 hours a day.

Wat is spam?
Spam wordt gedefinieerd als unsolicited commercial email (UCE) of als unsolicited bulk e-mail (UBE), oftewel: mail die in aanzienlijke hoeveelheden (bulk) en ongevraagd (unsolicited) wordt verstuurd. Ongevraagd houdt in dat de ontvanger geen aantoonbare en expliciete toestemming heeft gegeven voor de verzending van de e-mail. Bulk houdt in dat de e-mail onderdeel is van een aanzienlijke hoeveelheid e-mails, die elk voor een wezenlijk deel identiek zijn.

Om als spam gekwalificeerd te kunnen worden dient een e-mail ongevraagd en in bulk verzonden te zijn. Ongevraagde e-mails zijn normaal en geaccepteerd, denk daarbij aan persoonlijk contact, een vraag die je aan iemand naar aanleiding van zijn website stelt, etc. Bulk e-mails zijn normaal en geaccepteerd, denk daarbij aan e-mail die je ontvangt via mailinglists en nieuwsbrieven. Alleen de combinatie van ongevraagd en in bulk verzonden maakt een e-mail tot spam.

Vaak (maar niet altijd) gaat het om commerciële mail: men wil je een product verkopen, van viagra of een hypotheek tot prozac of porno. Ook ongevraagde aankondigingen van culturele evenementen, politieke of activistische oproepen en dergelijke vallen echter onder de noemer «spam».


Maar 't is voor een goed doel! Mag dat ook niet?
Nee, ook voor een goed doel mag je niet spammen, want spam blijft spam. Bovendien, wat u een goed doel vindt (een oproep voor een demonstratie of het zetten van een handtekening) vindt een ander een ongewenste politieke uiting.


Hoe mag ik dan wel een mailing versturen?
U mag alleen massa email versturen als de ontvangers hier EXPLICIET en aantoonbaar om gevraagd hebben. Dit principe heet confirmed opt-in. Elke andere manier van massa mail (opt-out/opt-in) is binnen ons netwerk NIET toe gestaan.


Wat is precies de goede manier?
De eigenaar van een e-mailadres moet expliciet en aantoonbaar toestemming hebben gegeven voor het ontvangen van e-mail van een mailinglist.

Dat is betrouwbaar te verifiëren door gebruik te maken van confirmed opt-in. Na aanmelding krijgt de eigenaar van het e-mail adres een verzoek om bevestiging opgestuurd, met daarin de vraag of hij zich daadwerkelijk wil aanmelden voor de mailinglist (of voor een nieuwsbrief of iets dergelijks). Indien de eigenaar van het bewuste e-mailadres geen bevestiging terugstuurt, moet er vanuit gegaan worden dat iemand anders dat adres heeft opgegeven (of dat de eigenaar zich heeft bedacht). Indien de houder van dat e-mailadres de vraag bevestigt, geeft hij expliciet aan dat hij toestemt met de ontvangst van e-mails via die mailinglist.

Om het helemaal goed te doen, wordt in de e-mail waarin de houder van het e-mailadres om bevestiging wordt gevraagd een niet te raden code meegestuurd. Alleen met die code kan de bevestiging geretourneerd worden. Dat heeft als voordeel dat derden de bevestiging niet kunnen vervalsen.

Tevens zou er in de e-mail waarin om bevestiging wordt gevraagd een adres opgegeven kunnen zijn via welke de houder van het e-mail vermeende misbruik kan melden. Op die manier is beter na te gaan of de mailinglist misbruikt wordt.

Het is dus de bedoeling dat bij een inschrijving de gebruiker expliciet en aantoonbaar toestemming geeft voor het ontvangen van e-mail van een mailinglist. Geeft hij deze toestemming niet en ontvangt hij wel e-mail van die mailinglist, zijn die e-mails op te vatten als spam.


Maar volgens de Nederlandse wet mag er gewoon gespammed worden!
Helaas is de wetgeving rond spam e.d. op dit moment nog niet goed geregeld. Er zijn een aantal wetten in aankomst die hier wel duidelijk op in gaan. Tot dan is het volgens onze Algemene voorwaarden niet toegestaan om deze activiteiten via of op ons netwerk te doen.


Ik heb van jullie een email gekregen met daarin een spamklacht. Wat nu?
We zijn hier heel duidelijk in. U moet actie ondernemen om herhaling te voorkomen. We geven 1 (een) waarschuwing, daarna sluiten we onze dienst af. Op welke manier dit zal zijn ligt aan de dienst die afgenomen wordt. Mocht het een zogenaamde "known-spammer" zijn, sluiten we direct af.


Maar de klacht is onterecht!
Dat is iets wat wij beoordelen. Let op, het is verplicht om via confirmed opt-in te werken, wij kunnen u verzoeken om de confirmatie van de klagende partij te overleggen. Kunt u dit niet dan kunnen wij niets anders dan er van uitgaan dat het spam is.


Waarom nemen jullie zulke strikte actie?
Omdat bij spam ons netwerk en onze naam in gevaar komt. Ons netwerk omdat we in zo genaamde blacklists kunnen komen, waardoor het voor onze klanten niet meer mogelijk is om email af te leveren bij bepaalde providers. Onze naam omdat we door deze blacklists onze dienstverlening niet meer optimaal kunnen houden, waardoor klanten weg gaan, of we potentiele klanten mislopen. Dit is uiteraard een situatie die we altijd willen voorkomen.

COVERAGE
This web site availability service level agreement (SLA) applies to you if you have ordered any hosting plan ("service") and you are in good financial standing with MijnDomein.com / Beter Webhosting BV.

SERVICE LEVEL
MijnDomein.com / Beter Webhosting BV endeavors to have network connectivity available by http access by third parties 99% of the time ("web site availability").

CREDITS
In the event that there is no web site availability, MijnDomein.com / Beter Webhosting BV will credit the monthly service charge for the service as calculated below and as measured 24 hours a day in a calendar month. The maximum credit is not to exceed the monthly service charge for the affected month:
  • Monthly Uptime: 90% - 99% - 10% credit
  • Monthly Uptime: 80% - 89.9% - 25% credit
  • Monthly Uptime: 65% - 79.9% - 50% credit
  • Monthly Uptime: 50% - 64.9% - 75% credit
  • Monthly Uptime: 49.9% or below - 100% credit
MijnDomein.com / Beter Webhosting guarantees 99% network uptime, or money back!

In order for you to receive a credit on your account, you must request such credit within two (2) business days after you experienced web site unavailability so that we may check our stats. You must request credit by sending a request to our billing department via our helpdesk. The message must contain your domain name, the dates and times of the unavailability of your web site, and such other customer identification requested by MijnDomein.com / Beter Webhosting BV. Credits will usually be applied within ninety (90) days of your credit request. Credits will only be paid through PayPal to the e-mail address listed in our administration. Credit to your account shall be your sole and exclusive remedy in the event that there is no web site availability.

RESTRICTIONS
Credits shall not be provided to you in the event that you have no web site availability resulting from (i) scheduled maintenance, (ii) your behavior or the performance or failure of your equipment, programs or applications, or (iii) circumstances beyond MijnDomein.com / Beter Webhosting BV's reasonable control, including, without limitation, acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labor disturbance, interruption of or delay in transportation, DDoS attacks (distributed denial-of-service), unavailability of interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies, or power used in or equipment needed for provision of your Web Site.

LIMITATIONS
Online problems occur continuously. There might come a time when you cannot access your website or any other service. This is not necessarily due to MijnDomein.com / Beter Webhosting BV. Perhaps your ISP is experiencing technical difficulties, or there might be a routing problem between your ISP and the data center utilized and maintained by MijnDomein.com / Beter Webhosting BV, making communication difficult or impossible. We cannot bear the responsibility of such problems. Our monitoring agents determine the uptime of our service, and not any one client's experience.

ACCOUNT RESTORE
MijnDomein.com / Beter Webhosting BV is not responsible for the restoration of data to server. We strongly recommend that you always have a recent backup of your account, and keep copies of your data off-site with you for emergency purposes. If hardware failure and data loss occur, you the client, are responsible for data restoration. MijnDomein.com / Beter Webhosting BV shall not be liable for loss of data under any circumstance.

HARDWARE REPLACEMENT
Hardware replacement will occur within 24 hours of the reported problem, MijnDomein.com / Beter Webhosting BV will refund 5% of the monthly fee per additional 24 hours of down time (up to 100% of customer's monthly fee). In order to reduce replacement hardware downtime, we keep a certain quantity of pre-built systems on hand to swap out hard disks so that your server can be back up in the shortest amount of time. For hard disk failures, we keep pre-installed drives with our standard partitioning for immediate deployment. In order to request a SLA hardware violation credit, you must within two (2) business days of reported violation contact our sales department via our helpdesk. SLA violations will be reviewed by our personnel Monday - Friday 9AM to 5PM CET. *Hardware SLA violations do not cover network violation*

Baffoon Internet services Holland ("BISH") Acceptable Use Policy (the "Policy") for Baffoon Internet services Holland Products and Services is designed to help protect Baffoon Internet services Holland, Baffoon Internet services Holland's customers and the Internet community in general from irresponsible or, in some cases, illegal activities. The Policy is a non-exclusive list of the actions prohibited by Baffoon Internet services Holland. Baffoon Internet services Holland reserves the right to modify the Policy at any time, effective upon posting at http://www.baffoon.nl/abuse.html.

Prohibited Uses of Baffoon Internet services Holland's Systems, Products and Services

1. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

2. Sending unsolicited mail messages, including the sending of "junk mail" or other advertising material to individuals who did not specifically request such material ("e-mail spam"). This includes, but is not limited to, bulk-mailing of commercial advertising, informational announcements, and political tracts. It also includes posting the same or similar message to one or more newsgroups (excessive cross-posting or multiple-posting). Baffoon Internet services Holland accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider.

3. Unauthorized use, or forging, of mail header information (e.g. "spoofing").

4. Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., "cracking").

5. Obtaining or attempting to obtain service by any means or device with intent to avoid payment.

6. Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any Baffoon Internet services Holland customers or end-users by any means or device.

7. Knowingly engage in any activities that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any Baffoon Internet services Holland customers or end-users whether on the Baffoon Internet services Holland network or on another provider's network.

8. Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send e-mail spam, initiation of pinging, flooding, mail-bombing, denial of service attacks, and piracy of software.

9. Using Baffoon Internet services Holland's Services to interfere with the use of the Baffoon Internet services Holland network by other customers or authorized users.

Each Baffoon Internet services Holland customer is responsible for the activities of its customer base/representatives or end-users and, by accepting service from Baffoon Internet services Holland, is agreeing to ensure that its customers/representatives or end-users abide by this Policy. Complaints about customers/representatives or end-users of a Baffoon Internet services Holland customer will be forwarded to the Baffoon Internet services Holland customer's postmaster for action. If violations of the Baffoon Internet services Holland Acceptable Use Policy occur, Baffoon Internet services Holland customer's Services reserves the right to terminate services with or take action to stop the offending customer from violating Baffoon Internet services Holland's AUP as Baffoon Internet services Holland deems appropriate, without notice.
